HOME STUDY SEMINAR PARTICIPATION AGREEMENT
This Agreement sets forth the terms and conditions under which you have been accepted as a participant in the Cranial Release Technique, Inc. (hereinafter “CRT, Inc.”) home study seminar regarding its technique of aligning bones in the head by applying pressure to specific areas of the skull (hereinafter the “Technique”). In consideration of obtaining special training and information to enhance your practice from CRT, Inc. and by executing this Agreement you acknowledge that you have read and understand this agreement and accept its terms and conditions set forth herein. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT EXECUTE.
The Technique is a therapeutic system based on the extensive practice, teachings and philosophies of cranial based healthcare together with the understanding of and resultant effects of this hands-on approach to releasing the body’s inborn capacity to heal. You hereby acknowledge that the Technique and the trademark CRANIAL RELEASE TECHNIQUE is the exclusive property of CRT, Inc.
As a seminar or home study participant you have obtained confidential information from CRT, Inc, and a confidential relationship regarding the Technique has been established. As part of this agreement you hereby agree, stipulate, promise, ensure and understand that you have a confidential relationship with CRT, Inc. and that you are not to disclose, teach, expound, edify or in any other manner disburse the knowledge and information disclosed during the seminar or in documents, videos or other materials distributed by CRT, Inc. concerning and related to the Technique under any circumstances, whether in person, writing or by any other means of communication, other than for use by you in your practice. This agreement shall remain in effect whether or not your Membership with CRT, Inc. is current. Furthermore, the information received from CRT, Inc. is considered confidential information and any information received from CRT, Inc. is also considered a “Trade Secret” of CRT, Inc. Any teaching, sharing and/or disclosure, including documents, videos, or other materials distributed by CRT, Inc. concerning the Technique without the specific written consent of CRT, Inc. including but not limited to using the CRT, Inc. name shall be deemed an unauthorized use and in violation of the CRT. Inc.’s rights and shall entitle CRT, Inc. to seek damages including but not limited to monetary, injunctive relief, its reasonable attorney fees and costs in pursuing any legal claim against you and/ or your agents, servants, employees and/or representatives.
To the fullest extent permitted by law, the Seminar/ Home Study Participant shall indemnify and hold harmless CRT, Inc., their agents and employees from and against all claims, damages, losses and expenses, including but not limited to attorney’s fees arising out of or resulting from the Seminar/ Home Study Participant’s use of the Technique provided that such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death to the extent caused in whole or in part by any negligent act or omission of the Seminar/ Home Study Participant or anyone directly or indirectly employed or controlled by them.
It is hereby agreed that this agreement shall be construed under the laws of the State of New York and the parties hereby agree to venue in the State Court of New York, County of Queens.
